Can the.furniture company get un trouble for this..?

i have a queensize.bed with the head board is a mirror with shelves in the side and a big heavy thing that coonects the two on top of.the mirrors ok this morning i woke up and my boyfriend and 1year old daughter where steal in the bed sleeping i heard a big boom and the thing came down in them but my boyfriend covered our daughter n he got cut and my.bed is now filed with gl and my daughter coyld have been severly hurt if he wasnt rit their and the big heavy thig came down as well everything did i guess it wasnt screwed.right the guys from ashley furniture were the ones who put up the whole bed can they get in trouble or will they say its my fault kus i put stuff heavy there its a.shelf
